WEBSITE TERMS OF USE

These Website Terms of Use ("Terms") govern your use of www.aaanova.com (the "Site") and the content, forms, and scheduling tools available through it (the "Online Services"). The Site is owned and operated by Nova Inspections and Improvements LLC ("Nova," "we," "us," or "our"). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. ACCEPTANCE; RELATIONSHIP TO INSPECTION AGREEMENTS
By using the Site, you confirm that you are at least 18 years old and agree to these Terms. Your use of the Site is also subject to our Privacy Policy. If you hire Nova, your inspection or service will be governed by a separate written inspection or service agreement. That agreement controls over these Terms for everything about the service, including scope, fees, report ownership and sharing, limitation of liability, notice of claims, venue, and attorney fees.
2. INFORMATIONAL CONTENT ONLY
2.1 All Site content (text, photos, sample reports, sample deficiencies, videos, checklists, and blog posts) is general information and marketing. It is not an inspection report, legal advice, engineering or architectural advice, or a warranty, guarantee, or certification of any property or system.
2.2 Site content is not a substitute for an inspection performed under a written agreement or for advice from licensed professionals. You are responsible for decisions you make about buying, selling, repairing, or maintaining a property.
2.3 We do not guarantee that the Site is free of errors. The scope, limitations, and liability for any inspection are governed only by the signed inspection or service agreement.
3. SERVICES, PRICING, AND AVAILABILITY
Services, sample reports, prices, promotions, and availability shown on the Site may change without notice and are not binding offers. Final scope and fees are set by your written agreement and booking confirmation. Our standard fees include a $150 fee for cancellation or rescheduling with less than 72 hours' notice, a $50 fee for returned or reversed payments, and re-inspection and return trips at $275 minimum for the first hour plus $75 for each additional hour or part of an hour. Your agreement states the fees that apply to you.
4. ONLINE SCHEDULING, FORMS, AND COMMUNICATIONS
4.1 Online scheduling is a request. An appointment is confirmed only when we accept it, you receive confirmation, and you agree to the applicable inspection or service agreement and payment terms.
4.2 Please provide complete and accurate information about the property, access, and services requested. We are not responsible for delays or errors caused by inaccurate or incomplete information.
4.3 You consent to receive communications electronically, and you agree that electronic agreements, signatures, and notices satisfy legal writing requirements. We send text messages only if you opt in by checking a text-message consent box. Text-message consent is optional and is not a condition of booking or purchasing any service. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help. Section 9 of our Privacy Policy explains our text-messaging practices, including that we do not sell or share your mobile number or consent with third parties for their marketing.
5. INTELLECTUAL PROPERTY
5.1 Site Content: Site content, including logos, trade names, text, photos, graphics, layouts, and videos, is owned by Nova or its licensors. You may view and use the Site for personal, non-commercial purposes. Without Nova's written consent, you may not copy, republish, scrape, or redistribute Site content, or use Nova's name or logos in a misleading or unauthorized way.
5.2 Inspection Reports: Inspection reports, photos, and related data are owned by Nova. The client and Nova have agreed that the client will not share the report without Nova's permission and that Nova will not share it without the client's permission, as stated in the client's signed agreement and our Privacy Policy. Permission may be given by email.
6. USER CONTENT AND REVIEWS
6.1 You are responsible for content you submit, and you grant Nova a non-exclusive, royalty-free license to use it in connection with our business, subject to applicable law and our Privacy Policy.
6.2 Please do not knowingly post false statements about Nova. Nothing in these Terms restricts honest reviews, good-faith opinions, complaints to regulators (including the Arizona Board of Technical Registration and Arizona Registrar of Contractors), or any rights you have under consumer protection laws.
7. PROHIBITED USES
You may not use the Site to break the law, interfere with its operation, upload harmful code, scrape data, misrepresent your identity, or attempt unauthorized access. The Site's contact forms and published contact information are for people seeking inspection-related services. Unsolicited commercial solicitations are not authorized, and we may block senders who send them. We may suspend or block access for violations.
8. THIRD-PARTY LINKS AND SERVICES
The Site may link to third-party sites or tools. We do not control them and are not responsible for them. Your use of them is at your own risk and subject to their terms.
9. DISCLAIMER OF WARRANTIES
THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR ACCURACY, TO THE EXTENT PERMITTED BY LAW.
10. LIMITATION OF LIABILITY (SITE USE ONLY)
TO THE EXTENT PERMITTED BY LAW, NOVA IS NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SITE, AND NOVA'S TOTAL LIABILITY ARISING FROM USE OF THE SITE IS LIMITED TO $100. THIS SECTION DOES NOT APPLY TO INSPECTION OR OTHER SERVICES, WHICH ARE GOVERNED SOLELY BY THE APPLICABLE INSPECTION OR SERVICE AGREEMENT.
11. INDEMNIFICATION
You agree to indemnify Nova against third-party claims to the extent they are caused by your misuse of the Site, your violation of these Terms, or content you submit that infringes someone else's rights. This does not require you to indemnify Nova for Nova's own negligence.
12. GOVERNING LAW, VENUE, ATTORNEY FEES, AND TIME LIMIT
These Terms are governed by Arizona law. Before filing suit, either party may request non-binding mediation in Pima County, Arizona. Any action arising from use of the Site must be filed in a court of competent jurisdiction in Pima County, Arizona, and must be filed within one (1) year after the claim arises. In any such action, the prevailing party may recover reasonable attorney fees and costs, as determined by the court. Disputes about inspection services are governed by the applicable inspection or service agreement, which uses the same Pima County court venue and mutual attorney-fee terms.
13. FORCE MAJEURE
Nova is not liable for delays or failures caused by events beyond its reasonable control, such as natural disasters, power or internet outages, server disruptions, labor disputes, or government actions.
14. ACCESSIBILITY
We strive to make the Site accessible. If you have difficulty using any part of the Site, contact us and we will help, including by providing information in another format.
15. CHANGES
We may update these Terms by posting a new version with a new "Last Updated" date. Changes apply to Site use after posting. Changes do not alter a signed inspection or service agreement.
16. SEVERABILITY AND WAIVER
If any provision is found invalid, the rest remain in effect. Our failure to enforce a provision is not a waiver.
17. ENTIRE AGREEMENT
These Terms and our Privacy Policy govern use of the Site. Inspection and service agreements are separate and control for the services they cover.
